The Basic Court in Cacak has sentenced Goran V. from Zablace, who was accused of the criminal offense of domestic violence, to mandatory psychiatric treatment in a closed psychiatric institution, specifically a prison hospital. He was declared criminally insane at the time the crime was committed, when he beat his wife Nikolija V. almost to death with wooden stick.

The defendant's lawyer, Ivan Cvrkic, stressed that this means the results of the evidence presenting procedure were accepted, and the prosecutor withdrew the proposal to perform additional or new expert tests by the Medical Faculty in Belgrade.

"My position that this is unnecessary and superfluous evidence was accepted, because the factual situation has been completely established. In this case, the law won and the facts won. What is important to stress is that in this criminal procedure, neither the prosecutor has been defeated, nor am I the winner as a defense attorney. This is the only legal way to treat Goran for what he did. Let's be clear, he has not been released and is going to the prison hospital. He will be monitored there by the doctors, when they assess that he is sane, the court can be asked to abolish the measure. Bearing in mind the act he committed, he will certainly spend some time there," lawyer Ivan Cvrkic told RINA.

After the trial, the plaintiff's lawyer, Irena Ilic, said that she believes that in such cases it makes more sense to impose imprisonmeant than the security measure of mandatory psychiatric treatment, as evidenced by the event that took place just a few days ago in Atenica, Cacak.

"Considering the proposal of the Basic Public Prosecutor's Office, which was submitted today in a drastically changed form, I stress that the entire procedure, starting from the investigative phase before the Basic Public Prosecutor's Office, until the decision on the merits before the Basic Court was conducted in an unprofessional manner, taking the line of least resistance. I hope that because of the lack of interest of the acting competent authorities, we will not be reading about new victims in your media outlets, including about Nikolija," Ilic told RINA.

The victim's lawyer has no right to appeal against this verdict of the Basic Court.
