Slogan "Ready for Homeland" declared unconstitutional: It can be used only in THESE situations
The Council for dealing with the consequences of the rule of non-democratic regimes chaired by the president of the HAZU, Academician Zvonko Kusic should publish the conclusions on non-democratic regimes, fascism, the Ustasha movement, and the communist regime, and this comprehensive document should serve as a guideline and recommendation for the drafting of legal regulations. The public is most interested in the opinion of the Council on dealing with the past on the (dis)allowing the use of the Ustasha greeting "ready for homeland", the inscription "ready for homeland" in the coat of arms of the HOS (Croatian Defence Forces) and the five-pointed star, and whether the consensus was reached on these three things.
Academician Zvonko Kusic and Prime Minister Andrej Plenkovic, who founded the Council almost a year ago, are addressing this public debate.
- We produced two large documents, and for the first, we achieved a high level of agreement. In the second part, we dealt with normative acts. In some ways, the Chamber has dealt with all areas, often regulated, and often not regulated. The Chamber decided not to vote, but the Council's conclusion was that members who had differing views of these opinions should deliver those opinions later attached to the documents. There were no significant disagreements - Kusic said at the beginning, and then the prime minister went on, writes vecernji.hr.
- Today I received a document that has 30 pages and two big works. One is a general framework that, in a rational and methodological way, defines all the key concepts and problems our society faces during the rule of totalitarian regimes and is clearly determined by the culture of memory. That's what is most important to me when we talk about the first part of the document. The second part of the document, which refers to the legal regulation of the symbol of totalitarian regimes, is also very well written, it takes into account the existing constitutional and legal framework in the Republic of Croatia - Plenkovic said and added:
- This was necessary to bridge the great ideological divisions and to turn to the future and a tolerant and inclusive society.
Kusic then explained how, according to the Council's conclusions, the greetings should be treated, inscriptions, and symbols from the former regimes.
- "Ready for the homeland" in the HOS coat of arms can explicitly be used only in relation to those situations, places or cemeteries, where members of the HOS have died. This does not change the fact that the slogan is unconstitutional. That was the tolerance that was inherited and that is the exception which can me strictly tolerated. On the other hand, the red star and the communist symbols that mark the antifascist fight. We all know that these symbols were ambiguous, they also have a negative connotation about human rights violations and mass crimes, but they also have a positive connotation in the anti-fascist fight, so this part of the anti-fascist fight is indisputable, while the recommendations foresee that the part of the features that can be introduced under Article 39 of the Constitution, which is the promotion of hatred or violence, in which case it can remain, but it is left to the legislature, which can regulate this by legal acts - Kusic said.
