UNPLEASANT SURPRISE AT THE BORDER: Penalty for everyone who did not respond to the court summons

Citizens that do not answer to the court summons of the Magistrates Court will not be allowed to exit the country if they are on the wanted list, hence they will be held in prison outside the borders of Serbia.

Based on the changes of Law on offences this proposition was given to the courts four months ago. Irresponsible citizens will be punished in this way for not answering to the court summons.

That countermeasure is not related to the seriousness of the crime, but exclusively to the behavior of the one who did the crime. Warrant for someones arrest is given when someone is constantly avoiding the court summons - explains Zoran Pasalic, the president of the Court of Appeal for Blic.

Procedure is that the court sends the summons twice. If the charged person does not come and does not go to the competent institution, the court issues a warrant and gives it to the police to make the arrest. If the police is unable to find the charged person, hey send the report to the court and they put the person on the wanted list in entire Serbia.

When they find the accused, the police takes the person to the court. If the court doesn't work at the time, the person can be detained into custody for 24 hours.

- The law is applied for few months now and we are analyzing  every step. That has to be done carefully because arresting based on the warrant list presents serious deprivation of rights and the warrant can't be issued just like that - said Pasalic.

Pasalic said that there are 2.000 people on the Belgrade territory with 6.000 violations.

Statistic history shows that 72% of the citizens pay for the ticket they receive in the period of 8 days and 90% of them answer to the court regularly.

- It is a small number of those that are hiding and running, but they should be stopped because they gave up to 70 violations, even the serious ones. They put in danger all of us - claims Pasalic.
