SCANDALOUS: They admitted to kidnapping a child (2) in the middle of Belgrade, and the court released them!

The Appellate Court in Belgrade acquitted three accused who in 2009 kidnapped a two-year old Sebastian Fazlija at the fairgrounds in the capital city, even though they admitted to the criminal offense. The acquitted are Nikola Zivanovic who was then 21 years old, Nicholas I. (19), and  Nikola Nikolic (25), all three are from Belgrade.

They were accused of kidnapping a boy in front of his house in Brodarska 88a on July 24th, 2009.

They kidnapped the toddler while he was sitting on the sidewalk in front of his house and the kidnappers took him by car, "Renault Clio" with Italian license plates. However, the car broke down 300 meters down the road, and they  moved to a "Peugeot". Sebastian Fazlija was taken to Obrenovac on a raft, and the child was found by a worker the next morning at the end of the old Makiš road, next to a garbage.

The accused have been in custody for nine months, and they told police that they wanted to sell the child, while at the trial they claimed to have kidnapped him "for fun".

The Court, however, acquitted them on all charges.

- Even after 15 trials, from 2009 to 2015, guilt has not been proven. I can not believe that the court could not determine the legal qualification of the offense, if it was kidnapping or unlawful deprivation of liberty. Kidnapping is when the offender seeks a value from someone, however, the prosecution did not prove that they intended to sell the child or do something else with him - says the prosecutor, Zoran Zorbić.

Zorbić stated that the accused allegedly told the police that they wanted to sell the child for 500 to 700 euros, and later claimed that they were beaten by police officers who fabricated the lie, while police said there was no such pressure.

- In court they said that they did it for fun and to prove who is the bigger stud. That was said by the young man who got out of the car and took the child. They said that they were in the apartment, had two drinks, a little marijuana, got into the car and then teased eachother who was the bigger stud. Since they  kidnapped the child, they went to Obrenovac, gave him a sandwich and then changed his clothes - says the lawyer.

He states that there is a second instance court decision that says a child of two years has no freedom of movement.

- It is completely absurd, because his freedom of movement is achieved through his parents. The child was deprived of such a freedom, and finally came a releasing judgment. The prosecutor, who easily believed that it would be a conviction, lodged a formal, lukewarm appeal - says lawyer Zorbić.
