- In order to arrest someone, it is necessary to determine whether the legal requirements have been fulfilled, and that is not done by the Government or the Ministry of Justice, rather, the judicial authorities in Serbia according to relevant regulations of the Republic of Serbia - said Selakovic.
As he said, the Minister of Justice has the last word, but only when the fulfillment of legal preconditions are confirmed by judicial authorities.
- The decision in which the Trial Chamber released Vojislav Seselj to freedom "for humanitarian reasons", certainly means the entire corpus of human rights of the accused during the duration and it is said that one of the main reasons for his release were, I would say legally, the abnormal length of detention, and I would emphasize that his release was almost entirely unconditional - said the Minister of Justice.
He added that the only obligation of Serbia was not to issue passports.
- What I want to say clearly and unequivocally is that Serbia is a state of law. Gone are the days when people were sent off to The Hague like a parcel in the mail, without respect to any legislation. Serbia is a state of law and has a law regulating cooperation with the Tribunal and that law will be respected. All of Mr. Seselj's rights as the defendant, including his right to oppose, will be taken into consideration - said Selakovic.
The Appeals Chamber of the Hague Tribunal, which asks that the Serbian government to arrest and extradite Vojislav Seselj, in a letter to the Ministry of Justice of Serbia states that Seselj's health can not prevent his return to Scheveningen.
Seselj's health condition "would not even have to be marred in his return to The Hague," said in a letter to the Serbian Ministry, this document requested that the Government of Serbia,immediately arrest and extradite Seselj to The Hague by May 26 or as soon as practicable after that date.
