Extramarital and marital partners in Serbia under the law are equal in almost every way, except in the most important - the inheritance of property and pensions! The only way to leave assets to extramarital partners is to state it in the will, writes Blic.
When a testament concerning the inheritance of property does not apply to the legal order of succession according to the Law on Inheritance, the common-law partner does not exist, but until this issue can be resolved with a will, inheritance of the family pension is IMPOSSIBLE!

RIGHTS of an unmarried partner in Serbia:
- They have the right to:
* The division of property they acquired together in case of a split
* Compensation for mental suffering in the event of the death of a partner
* The support from the father of a child three months before and one year after childbirth

- They do not have the right to:
* The assets of the partners, unless specified in the testament
* Family pension after the death of a partner
* Cohabiting partner does not count as a family member in the tax exemption for the first apartment
