Nina's boy is being taken away today to hand him over to father: The entire city is on the streets, they will defend the small boy (7) (VIDEO)
A public gathering has been reported to the police since 9 am, in front of the building in Split, where Nina Kuluz lives, and is organized by Facebook group "Save Little Cesar". Around 500 people are supposed to come
Decision about guardianship should be implemented today in Croatia according to the rule of the Split Municipal Court, which means that the small Cesar (7) will be separated from his mother and he will go to live with his father Alessandro Avenati. This case has risen the entire Croatia to its legs, and the situation is particularly difficult considering that Nina escaped from her husband from Turin six years ago because he harassed and threatened her, and little Cesar could be torn away from the only known environment to him, which could cause severe trauma.
The father, Alessandro Avenati, initiated a series of proceedings in Italy and in Croatia, and according to the court decision, the boy should go to live with his father. Two criminal proceedings are being conducted in both countries against Kuluz, for having taken the child from Italy without the consent of his father.
The Mayor of Split, Andro Krstulovic, promised to help the small Cesar's mother by co-financing the lawyer's expenses. The taking of the child from the mother should take place at 11 o'clock, while the boy's father and general consul of Italy Paolo Palminteri arrived in Split.
The police have set up fences around the entrance to Nina Kuluz's apartment, and many people protest and are determined to prevent the boy from being separated from his mother.
Separation from mother is not good for the boy
Nina Kuluz is being represented by lawyer Miso Zivaljic from Friday. He believes that a mistake was made in the proceedings because no one asked Cesar about the opinion, and that was necessary to do under European conventions, Index.hr writes.
- We have medical records according to which separation from the mother is not good for the boy. The court has so far disregarded our requests to postpone the taking of a child, but we will send a new request tomorrow. I work 24 hours a day on the case and I think that the court tries to close the case as soon as possible, but not for the welfare of the child - said Zivaljic, lawyer.
A public gathering has been reported to the police since 9 am, in front of the building in Split, where Nina Kuluz lives, and is organized by Facebook group "Save the Little Cesar". Around 500 people are supposed to come.
Gathering has the main goal of delaying the execution of this decision
- The main goal is delay. We ask that the case is sent to the revision, conduct the expertise of the parents, and that Cesar is asked for an opinion. Public gathering will be peaceful and dignified, for the benefit of the child. Cesar is the most important in this story. The whole Split is familiar with the case, we also put a banner on St. Duje yesterday. We will give passive resistance, they can only take us and arrest us - said the President of the City District of Pujanka, Petar Gudic.
Some citizens stayed all night before the apartment of Nina Kuluz. They stayed at the entrance to the apartment, and in the morning around 7:30 the police appeared and started preparing the fences. Citizens immediately prevented the police from entering the apartment of Nina Kuluz. The policemen entered only after the police talked with the organizer of the protest.
- Police officers provide assistance during the execution of the act of the competent court and the Center for Social Work. The police shall act in accordance with the law and the rules governing the cooperation between the courts, the police and the Center for Social Work. As for the public gathering, we have been duly notified and we secure it in accordance with the law on public gatherings, so far there was no need for intervention. The police will take all necessary actions to preserve public order and peace and to protect citizens. As for the execution of the court decision itself, all questions about it should be sent to the competent court - said Ana Cepic from the Split Police Administration.
