GENERAL DRAZA won the war against the Communists: Serbia rehabilitated Dragoljub Mihailovic, Tito's biggest enemy!
"The adoption of the request for the rehabilitation of General Dragoljub Draza Mihailovic and the annulment of the verdict of the Military Chamber of the Supreme Court of the FPRY on July 15, 1946 in the part referring to the commander of the Yugoslav Army in the Homeland, born on April 27, 1893 in Ivanjica to father Mikhail and mother Smiljana born Petrovic, from the date of its adoption, as well as all the legal effects of that decision, and the rehabilitated person shall be deemed free of convictions! " according to the ruling.
The first request for Mihailovic's rehabilitation was filed by his grandson Vojislav Mihailovic in 2006, after which he was later joined by several associations and parties.
Since this procedure is one-party, the right to appeal exists only in the case if the rehabilitation is rejected.
During this multi-year process, which was extremely enticing for the public and took up plenty of media coverage, the court heard evidence from dozens of witnesses, mostly historians, listened to audio recordings from the trial, and collected other documentation.

The proposal for rehabilitation that was submitted by Vojislav Mihailovic was joined in 2009 by the Serbian Liberal Party, with Kosta Cavoski as the head, the Association of members of the Yugoslav Army in the Homeland, the Association of Political prisoners and victims of the communist regime, international law professor Smilja Avramov and others.
Proponents argue that Mihailovic was not afforded the right to a defense and did not see his lawyer until his trial. He had no right to an impartial tribunal and the indictment was delivered to him seven days before the trial. Two days following the controversial ruling, Mihailovic was executed in Belgrade.
A special Commission is in the process of determining the exact location where he was shot, because it is assumed that his remains were moved to another location. Otherwise, Mihailovic has no burial site.
In the absence of other evidence of Mihailovic's death, the decision of the Basic Court in Belgrade in 2013, determined July 17, 1946 to be date of Mihailovic's death, since the court found that that was when he was executed.
